Terms & Conditions

These Terms and Conditions govern your use of staynobleescapes.com (the “Website”), operated by Noble Escapes Luxury Retreats (“Noble Escapes”, “we”, “us”), and your booking of Modern Magnolia and any other property Noble Escapes manages on Lake Oconee, Eatonton, Georgia. By using the Website or completing a booking, you agree to be bound by these Terms and Conditions.

Bookings and Payment

Reservations are made directly on the Website through the HomeRunner booking engine. Your booking, quote and guest details are processed by HomeRunner and synced to our property management system, Hostfully. Card payments are processed by the payment processor connected to the booking engine; Noble Escapes does not store your full card number.

A refundable security deposit applies to each stay; the amount is shown at checkout before you book ($1,000 for Modern Magnolia). Full payment terms, the security deposit, cancellation and modification terms, occupancy rules, check-in and check-out times, and all other stay-specific conditions are set out in the Short-Term Rental Agreement presented at checkout, which you accept when you complete your booking. That agreement governs your stay; it is not restated here.

Changes and Cancellations

Requests to change or cancel a reservation are handled under the cancellation and modification terms in the Short-Term Rental Agreement presented at checkout. Please refer to that agreement, or contact us, with any change or cancellation request.

Property Representations

The information and images on the Website are believed to be accurate at the time of publication. Noble Escapes reserves the right to make changes it deems necessary to reflect the property more accurately. Furnishings, appliances and other equipment are supplied at the discretion of the property owner as an added feature for guests. While we make reasonable efforts to keep such items in working order, Noble Escapes does not guarantee their availability or condition and is not responsible for replacing or refunding a guest for the unavailability of any such item during a stay.

Assumption of Risk

Use of amenities at the property, such as docks, decks, fire features or other outdoor features, may involve risk, particularly for children. Guests use any such amenities entirely at their own risk and initiative.

Liability and Indemnification

Lost or stolen personal items are not the responsibility of Noble Escapes or the property owner. Guests are solely responsible for securing the property and safeguarding personal items during their stay.

Noble Escapes and the property owner are not liable for any consequential damages, loss or expense arising out of or in connection with the use of, or inability to use, the property. To the extent permitted by Georgia law, the maximum aggregate liability of Noble Escapes and the property owner for all damages, losses and causes of action, whether in contract, tort or otherwise, will not exceed the contract price for the rental.

You agree to indemnify and hold harmless Noble Escapes, the property owner, and their agents, employees and contractors from and against any costs, damages, liabilities, claims and legal fees arising from your stay, including claims relating to property damage, personal injury or loss of life sustained by you or your guests in or about the property, except to the extent caused by the gross negligence or willful misconduct of Noble Escapes or the property owner.

Unavailability of the Property

If the property becomes unavailable for reasons beyond our control, we will use good-faith efforts to locate a comparable replacement property that reasonably meets your needs. If a suitable replacement cannot be secured, Noble Escapes will refund all payments made for the affected stay, and neither party will have further obligations under the booking.

General Provisions

These Terms and Conditions, together with the Short-Term Rental Agreement presented at checkout, contain the entire agreement between you and Noble Escapes regarding your use of the Website and your stay. Any amendment must be in writing and signed by both parties. These Terms and Conditions are governed by the laws of the State of Georgia, and any dispute arising out of their interpretation or application will be subject to the jurisdiction of the courts of the State of Georgia.

Changes to These Terms

We may update these Terms and Conditions from time to time. Changes take effect when posted on this page, and we will update the effective date above. Please review these Terms and Conditions periodically.
